Please read these Terms of Use carefully. By accessing the ValiMind website, registering a profile, taking an assessment, making a payment, or using our services, you agree to these terms and our Privacy Policy.

1. About These Terms

These Terms of Use govern your access to and use of the ValiMind Solutions website, candidate registration process, assessments, reports, talent-discovery services, and related communications (collectively, the “Services”).

“ValiMind”, “we”, “us”, and “our” mean ValiMind Solutions. “You” means a visitor, candidate, institution, employer, or other user of the Services.

2. Eligibility and Account Information

You must provide accurate, current, and complete information when using the Services. You are responsible for ensuring that the information, documents, qualifications, contact details, and other information you provide remain accurate and up to date.

You are responsible for safeguarding any account credentials, verification information, or access details associated with your use of the Services.

If you use the Services on behalf of an organisation, institution, employer, or other entity, you confirm that you have the authority to accept these terms on its behalf.

Where a user is under 18, use of the Services must be undertaken with the involvement and consent of a parent or legal guardian, where required by applicable law.

3. Candidate Profiles and Assessments

ValiMind may use the information you provide to create and maintain a candidate profile, administer assessments, generate assessment results and reports, communicate with you, and, where applicable and based on the relevant consent or other lawful basis, identify or communicate relevant employment, internship, education, or other opportunities.

You remain responsible for the accuracy, authenticity, and lawfulness of the information, documents, photographs, resumes, qualifications, and other content you submit.

Assessment scores, reports, and insights are intended to support employability, recruitment, talent identification, and related decisions. They are not a guarantee of employment, admission, interview selection, internship selection, salary, promotion, or any other particular outcome.

Employers, institutions, and other organisations may apply their own eligibility criteria, interviews, assessments, verification procedures, and selection processes. Their decisions are made independently of ValiMind.

4. Assessment Integrity and Acceptable Use

When participating in an assessment, you agree to follow all instructions and assessment rules communicated by ValiMind or the relevant employer or institution.

You must not:

• provide false, misleading, infringing, or unlawful information;
• impersonate another person or allow another person to take an assessment on your behalf;
• misrepresent your identity, qualifications, experience, academic record, employment history, or association with another person or organisation;
• share, copy, reproduce, record, publish, distribute, or disclose assessment questions, answers, test materials, or restricted assessment content without permission;
• use unauthorised assistance, devices, software, materials, communications, or other methods where such assistance is prohibited by the applicable assessment rules;
• attempt to manipulate, falsify, bypass, interfere with, or compromise an assessment, assessment score, result, or assessment-security mechanism;
• upload material you do not have the right to provide;
• interfere with, damage, bypass, or attempt to gain unauthorised access to the Services or related systems;
• copy, scrape, reproduce, resell, or commercially exploit the Services or their content without our written permission; or
• use the Services in a way that is unlawful, harmful, discriminatory, fraudulent, abusive, or disruptive.

Where ValiMind has reasonable grounds to believe that an assessment or related process has been compromised, ValiMind may investigate the matter and may suspend, invalidate, or withhold the relevant assessment result, subject to applicable law and any applicable contractual obligations.

5. Payment Terms and Conditions

Where a fee applies to a ValiMind product or service, the applicable price and payment method will be communicated on the website, registration page, payment page, invoice, or other applicable communication.

5.1 Payment Methods: Payments may be made using the payment methods made available by ValiMind from time to time, which may include UPI, online payment gateways, bank transfer, or other authorised payment methods.

5.2 Payment Authorisation and Transaction Issues: ValiMind is not responsible for a payment being declined, delayed, reversed, blocked, or otherwise unsuccessful due to reasons attributable to your bank, payment service provider, payment gateway, financial institution, transaction limits, incorrect payment details, network issues, or other circumstances outside ValiMind’s reasonable control.

5.3 Currency: Unless expressly stated otherwise, payments for services offered through the ValiMind website must be made in Indian Rupees (INR).

5.4 Successful Receipt of Payment: A payment will be treated as received only when the applicable payment has been successfully credited or otherwise confirmed by ValiMind or its authorised payment service provider.

5.5 Duplicate Payments: You are responsible for checking whether a transaction has already been completed before making another payment. If you accidentally make a duplicate payment, any reversal or refund will be handled in accordance with the applicable payment-provider procedures and ValiMind’s applicable refund policy, subject to applicable law.

5.6 Refunds and Cancellations: Fees are generally non-refundable once the applicable assessment, service, or processing has been initiated, except where ValiMind expressly provides otherwise or where a refund, cancellation, or other remedy is required under applicable law.

5.7 Misuse or Disruption of Services: ValiMind may suspend or cancel access to a service where it has reasonable grounds to believe that a user has misused, attempted to misuse, or is likely to misuse the ValiMind Services, assessment platform, assessment process, payment process, or related systems, or has attempted to disrupt or interfere with any assessment, test, event, or process.

Any action taken under this section will be subject to applicable law and any refund or other rights that may apply.

5.8 Payment Exceptions: Any refund, cancellation, adjustment, or other exception will be handled in accordance with the applicable ValiMind policy, contractual terms, payment-provider procedures, and applicable law.

6. Intellectual Property

The ValiMind name, logo, website design, assessment materials, assessment questions, reports, text, graphics, software, documentation, and other content are owned by or licensed to ValiMind and are protected by applicable intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable right to access and use the Services for their intended purpose. No ownership or other intellectual-property rights are transferred to you through your use of the Services.

7. Third-Party Services and Links

The Services may contain links to or use third-party services, including payment gateways, cloud-service providers, educational institutions, employers, communication services, analytics providers, or other service providers.

Third-party services may be governed by their own terms, conditions, and privacy policies. ValiMind is not responsible for the independent content, availability, security, or practices of third-party services, except to the extent required by applicable law.

8. Service Availability and Changes

We may update, modify, suspend, or discontinue all or part of the Services when reasonably necessary, including for maintenance, security, legal compliance, operational requirements, or improvement of the Services.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. Where reasonably possible, we may take steps to restore or address material service interruptions.

9. Disclaimer and Limitation of Liability

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

ValiMind does not guarantee a particular employment, recruitment, internship, educational, career, or business outcome.

ValiMind is not responsible for independent decisions made by candidates, employers, institutions, recruiters, or other third parties based on information, scores, reports, or insights obtained through the Services.

Nothing in these Terms limits or excludes any liability, responsibility, consumer right, or remedy that cannot lawfully be limited or excluded under applicable law.

10. Suspension or Termination

We may suspend or terminate access to the Services if we reasonably believe that these Terms have been breached, if required by law, or where necessary to protect the security, integrity, or proper operation of the Services.

You may stop using the Services at any time.

Suspension or termination does not affect rights or obligations that accrued before the suspension or termination, to the extent permitted by applicable law.

11. Governing Law and Disputes

These Terms are governed by the laws of India.

Before beginning formal legal proceedings, you agree to contact ValiMind first so that the matter may be considered and, where reasonably possible, resolved in good faith.

Nothing in this section prevents you from exercising any statutory consumer, privacy, or other legal right or remedy available to you under applicable law.

12. Grievances and Complaints

If you have a complaint or concern regarding registration, assessments, payments, services, privacy, or any other matter relating to ValiMind, you may contact us using the details below.

Please provide sufficient information to help us understand and investigate the issue, including your name, registered email address, candidate ID or transaction details where applicable, and a description of the concern.

We will review and address complaints in accordance with our applicable policies and the requirements of applicable law.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will post the updated version on this page and update the “Last updated” date.

Your continued use of the Services after an updated version is posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
